Terms of Service and Acceptable Use Policy for mylist.site

This document (the "Agreement") is a legally binding contract between you ("User," "Creator," or "Customer") and mylist.site ("the Platform," "we," "us," or "our"). By accessing, browsing, or creating an account on mylist.site, you acknowledge that you have read, understood, and agree to be bound by every provision herein.
1. Acceptance and Scope
This Agreement governs all use of mylist.site and any services, features, or content offered by the Platform. We reserve the right, at our sole and absolute discretion, to modify or replace any part of this Agreement at any time. Your continued use of mylist.site following the posting of changes constitutes acceptance of those changes.
2. Eligibility and Account Security
To use mylist.site, you must be at least 18 years of age. You represent and warrant that all information provided during registration is truthful and accurate. You are solely responsible for all activity under your account. We reserve the right to deny service, terminate accounts, or remove content at our discretion without prior notice or liability.
3. Absolute Prohibitions on Content
To maintain a safe and commercially viable environment, mylist.site enforces a strict zero-tolerance policy. The following content is categorically prohibited:
Adult and Pornographic Content: Any depiction of explicit sexual activity, genitals, nudity for the purpose of sexual arousal, or highly suggestive "NSFW" imagery.
Illegal and Regulated Goods: The promotion or sale of firearms, ammunition, explosives, tobacco, e-cigarettes, vaporizers, CBD, THC, prescription drugs, or controlled substances.
Violence and Exploitation: Content depicting real-world violence, gore, self-harm, animal cruelty, or the exploitation of minors.
Hate Speech: Content that promotes violence or hatred against individuals or groups based on race, religion, disability, age, nationality, veteran status, sexual orientation, or gender identity.
Infringing Material: Content that violates the intellectual property, privacy, or publicity rights of any third party.
4. Financial and Transactional Restrictions
Users must not use the Platform for high-risk or prohibited financial activities, including:
Fraud and Scams: Phishing, pyramid schemes, "get rich quick" schemes, or deceptive marketing practices.
Unlicensed Regulated Services: Unlicensed gambling, sports betting, or financial investment advice.
Counterfeit Items: The sale of unauthorized replicas or "knock-offs."
Money Laundering: Using the Platform to disguise the origin of funds or engage in any suspicious financial behavior.
5. Intellectual Property and Licensing
Platform Rights: mylist.site owns all rights, titles, and interests in the brand name mylist.site, its logos, code, design, and user interface.
User Content License: By posting content on mylist.site, Creators grant us a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.
Feedback: Any suggestions or feedback provided to us regarding mylist.site becomes our sole property without compensation to the User.
6. Our Rights to Monitor and Enforce
We reserve the following rights to protect the integrity of mylist.site:
Discretionary Removal: We may remove, edit, or block any content or account at any time, for any reason or no reason, without notice.
Investigation: We may investigate any suspected violation of this Agreement and cooperate with law enforcement or payment processors in doing so.
Brand Protection: We may terminate any account that we believe, in our sole judgment, negatively impacts the reputation of the brand name mylist.site.
7. Disclaimer of Warranties
mylist.site is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.
8. Limitation of Liability
To the fullest extent permitted by law, mylist.site, its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in the six months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless mylist.site and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Platform, your violation of this Agreement, or your violation of any third-party rights.
10. Third-Party Links and Transactions
mylist.site contains links to third-party websites. We do not monitor or control these sites and are not responsible for their content or privacy practices. Any transaction between a Customer and a Creator is a private contract; mylist.site is not a party to such transactions and disclaims all liability related thereto.
11. Termination
We may terminate or suspend your access to mylist.site immediately, without prior notice or liability, for any reason whatsoever, including your breach of these Terms. Upon termination, your right to use the Platform will cease immediately.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of Canada. Any disputes arising from this Agreement shall be resolved exclusively in the courts located in Ontario Canada, and you consent to the personal jurisdiction of such courts.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and mylist.site regarding the use of the Platform and supersedes all prior agreements or communications.
